Terms and Conditions for Flooring Installation

1. Agreement Overview

These Terms and Conditions constitute a legally binding agreement between Golden Carpets Kirrawee Pty Ltd and the Customer for the provision of flooring installation services.

By accepting Golden Carpets quotation and proceeding with the installation, the Customer agrees to the following terms and conditions.

2. Quotation and Acceptance

2.1. All quotations provided by Golden Carpets are valid for 30 days from the date of issue.

2.2. Deposits are considered as an acceptance of the quotation and authorization to proceed on your behalf and are not refundable.

2.3. Any variations or amendments to the original quotation must be agreed upon in writing by both parties.

3. Scope of Work

3.1. The Company will provide flooring installation services as specified in the quotation.

3.2. Any additional work requested by the Customer that is not included in the original quotation will be subject to additional charges.

4. Payment Terms

4.1. A deposit is required upon acceptance of the quotation. Please see quotation for details.

4.2. A further payment is required 4 days before installation unless stated on invoice.

4.3. The remaining balance is payable upon completion of the installation.

4.4. Please be advised a charge of 5% per month will be charged on overdue amounts.

5. Customer Responsibilities

5.1. The Customer must ensure that the installation area is clear of all furniture, personal belongings, and any obstructions prior to the commencement of work.

5.2. The Customer is responsible for providing access to electricity and water during the installation process.

5.3. It is the client’s responsibility to make sure doors have adequate clearance for the new flooring.

5.4. If the client has requested the shifting of furniture, please ensure the furniture is empty prior to the installer’s arrival. It is the client’s responsibility to remove and replace personals, collectables, bedding and clothing prior to the installer’s arrival. It is the client’s responsibility to remove computers, televisions, bunks, storage beds, water beds, electric beds, safes, fish tanks or pianos. We do not reconnect any electricals. Golden Carpets takes no responsibility for any damage incurred from shifting prefab furniture.

5.5. Golden Carpets is not responsible for the sub-floor. Any sub-floor repairs are at the client’s expense unless detailed in this Invoice.

5.6. Self-levelling compounds are used to create a smooth sub strata, not to level the floor (unless detailed in this Invoice).

5.7. While all care is taken, freshly painted walls and skirtings may be marked during the installation process. Golden Carpets will not be responsible for any costs involved with touching up paint work.

5.8. Bowing is a distortion visible as wavy or crooked lines when viewed across carpet width in loop or patterned carpets. A bow of up to 40mm is considered acceptable by carpet manufacturers.

5.9. For the safety of our installers, it is imperative that clients disclose the location of any water pipes, gas pipes, electrical wiring, underfloor heating, or other potential hazards prior to the commencement of work. Despite the utmost care being taken, the use of sharp tools during flooring installation carries a risk of puncturing underfloor heating systems, pipes, and wires. Consequently, our company cannot assume financial responsibility for any damage that may arise.

6. Installation Schedule

6.1. Golden Carpets will make every effort to adhere to the agreed installation schedule. However, the Golden Carpets shall not be liable for any delays caused by circumstances beyond its control.

7. Material Warranty

7.1. Any material warranty claims must be made in writing within the manufacturer’s warranty period.

8. Workmanship Warranty

8.1. Golden Carpets warrants that all installation work will be carried out to a high standard of workmanship.

8.2. Any defects in workmanship must be reported to the Golden Carpets in writing within 5 days to limit further defects. Failure to do so may void your warranty.

8.3. Golden Carpets warrants workmanship for 356 days from the installation date.

9. Limitation of Liability

9.1. Golden Carpets shall not be liable for any indirect, incidental, or consequential damages arising from the installation services.

9.2. Golden Carpets liability for any claim related to the installation services shall not exceed the total amount paid by the Customer for those services.

10. Termination

10.1. An invoice can only be cancelled if the product has not been despatched by the manufacturer. In some cases, products can be returned. (restocking & freight charges may apply)

10.2. Return policy. We do not accept the return of any products cut from stock. We do not accept the return of opened boxes. Restocking and return freight charges apply.

10.3. In the event of termination by the Customer, the Customer shall be liable for payment of all work completed up to the termination date.

11. Dispute Resolution

11.1. Any disputes arising out of or in connection with this agreement shall be resolved through good faith negotiations between the parties.

11.2. If the parties cannot resolve the dispute within 60 days, the matter may be referred to mediation or arbitration as agreed by both parties.

12. Governing Law

12.1. This agreement shall be governed by and construed in accordance with the laws of New South Wales Australia.

13. Entire Agreement

13.1. This agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, and representations.

14. Amendments

14.1. Any amendments to this agreement must be made in writing and signed by both parties.

15. Failure to complete payment

15.1. Ownership of all goods remains with Golden Carpets until full payment of the invoice is received. We reserve the right to retrieve any goods not paid for in full.

16. Severability

16.1. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
